City Denies Bulldog, Public Lawsuit Amounts

 

On March 29, The Bulldog sent a message to City of Ottawa media relations concerning the amount of money being spent on claims concerning the light-rail project.




This was the question:

Folks: What are the dollar values of disputes and lawsuits over $10 million concerning the light-rail project?

I’d like a list of the disputes and lawsuits with each occurrence showing its dollar value. That includes disputes and lawsuits that have not been released to the public which the public has very much a right to know as citizens and taxpayers. If you cannot provide exact figures give the public a realistic estimate.

Ottawans need full accountability of the actions of their representatives and public servants as is prescribed in the values of a democracy.

Good afternoon, Ken,

Please see the response below from staff.

“Any disputes between the City and the Project Companies on the LRT Projects are governed by the terms of the applicable Project Agreement and any related agreements. In keeping with the City’s practices, any resolutions of such disputes are confidential and cannot be publicly disclosed, including because of confidentiality provisions contained in any applicable settlement agreement.

Courts recognize that settlements serve the public interest by saving time and money, reducing the need for trials, and allowing parties to work together to resolve disputes. They also recognize that settlements are an essential part of the legal system, and that confidentiality is often necessary to reach a settlement. The City respects the importance of the settlement process in relation to any disputes in which it is involved.”

    I would be interested to know if it is the City or the private party who requests confidentiality.
    Has the City ever sought to have confidentiality clauses removed from contracts?

    I understand confidential agreements and secret payments can be tracked through disbursements in annual budgets which do not disclose the subject of payments. It will not disclose the file number but will give a “total” each year without details. Also, “reducing the need for trials” seems to be the go to excuse for our city legal staff.
